Legislative response in the United States to Y2K litigation

Here is an expert article from Orange County based Lawyer Todd Picker just for the Apollo News Blog…It seems that changing the way dates are recorded and calculated electronically should not be that difficult a task. As a matter of fact, the Y2K issue does not at first blush seem much harder than switching over the time on a  Rolex, but sadly, due to the relative age of the computer systems involved and too that computer-generated dates may be the result of information stored in different places within the computer’s memory, very costly review, and in many cases in  neededquestion replacement of electronic data processing equipment, computer-related hardware plus software was badly to correct the problem. The overall expense of modifying them prior to the tirn of the century date rolled over to the year 2000 arrived, therefore, was enormous. Orange County and need a qualified Orange County Accident Attorney then call the Law firm of Todd Picker as he is a first rate and effecient Orange County Accident Attorney and can help with so many types of accident related cases.

While commentators speculated as to the potential affects the Y2K problem might have on commerce and day-to-day life, a general consensus emerged that a large volume of undesirable and counter-productive litigation would result. Consequently, in the United States resolving the Y2K issue necessarily encompassed taking into account the anticipated legal consequences arising from the problem. Congress responded by enacting the “Y2K Act”.’ The legislation’s purpose is described as follows:

1. See 15 u.s.c. 6601 et seq.

[2000) I.C.CL.R. ISSUE 4 © SWEET & MAXWELL LIMITED [AND CONTRIBUTORS)

[T]he purposes of this Act are-(l) to establish uniform legal standards that give all businesses and users of technology products reasonable incentives to solve year 2000 computer date-change problems before they develop; (2) to encourage continued remediation and testing efforts to solve such problems by providers, suppliers, customers, and other contracting partners; (3) to encourage private and public parties alike to resolve disputes relating to year 2000 computer date-change problems by alternative dispute mechanisms in order to avoid costly and time-consuming litigation, to initiate those mechanisms as early as possible, and to encourage the prompt identification and correction of such problems; and (4) to lessen the burdens on interstate commerce by discouraging insubstantial lawsuits while preserving the ability of individuals and businesses that have suffered real injury to obtain complete relief. Now, that is complicated, it really takes an attorney to understand it all.

Adobe and Apple have Joined Forces

Adobe had an event “Flash On The Beach” in which they made public that they are now developing a flash player for the iPhone. This comes following various statements by Steven Jobs, stating that the current version of flash for the iPhone is not quite good enough.
This Adobe flash may not be seen right away until it is developed to work correctly with the iPhone and Apple determines what apps make it into the App Store. It may not actually be seen in the near future since Flash has the ability to cause CPU overload on computers and on smartphones.

Meanwhile in related news, the technology firm from Finland which produces the Nokia cell phones has just released their latest the 5800 Xpressmusic phone. All in all, this is the very first touch screen phone the company has released and with it they are setting their sights on competing for a part of the digital music market that the Apple corporation currently dominates.

This particular phone will be made available to customers for free when they sign a service contract, which will place certain pressures on Apple’s iPhone. According to Jo Harlow the head of the phones, they think that they will listed with most of the mobile firms in due time.

Meanwhile in official statements from the Nokia Corporation as part of their free music bundle they have named “Comes with Music”, they claim to have all the major music labels and many of the independent labels with as many as five million tracks.

They also have plans of offering their music service in America next year in competition with the Apple Corporation, which now is in control of more than half of the digital music sales with iTunes.

Email Spammer Sentenced in the Emerald City

A man who is known as the “Spam King: aka Robert Soloway was sentenced for the millions of unsolicited emails sent to world wide web users was sentenced in a Seattle court to approximately four years in prison. Authorities in question had asked for more than 2 times the amount of years he was ultimately sentenced to under the Can-Spam Act because of his high profile criminal activities, but his lawyer had reduced the sentencing.
He is only the second person to be convicted under the Can-Spam Act and he stated in court he did this to afford a luxury apartment and expensive clothing.
Investigators found that he used a program named Dark Mailer to get into a network of botnets that sent bulk emails anonymously. Soloway had sent for commercial clients and used the addresses of real people without their knowledge.
By using the programs that Soloway used that switched the emails to appear the person had sent it to themselves rather than it coming from Soloway it was argued that this violated the Can-Spam Act.
Assistant U.S. Attorney Richard Cohen asked for a nine year sentence in the case and Judge Pechman who presided over the sentencing after Soloways guilty plea also heard from Soloway and chose sentencing years less than the Assistant U.S. Attorney asked for.
Soloway claimed that he had ”earned’ around $120,000 during 2005 and then became accustomed to living in a high end lifestyle and while he is now ashamed of his criminal actions at the time of the events he was worried with keeping this life style. He also stated the funds that he made in 2005 was not enough to actually keep up with his huge credit card debt.

Cell phone Trafficers try out some New Tricks

Cellular telephone traffickers have found some new angles. They have found that by obtaining fairly cheap prepaid mobile phones and manipulating the software, they can be used to make phone calls on all networks. After they are unlocked, they are then sold all over the globe.

The mobile telephones in question are obtained in retail stores all over in Oregon, Florida, Maryland and some other states. In addition, many individuals have been hired to be runners. They generally into the retail stores and buy up the prepaid phones when the prices are low. The mobile are then hacked into and resold at perhaps fifty or sixt dollars over the regular cost. Hacking into the phones and reconfiguring the software is not actually against the law, surprisingly. But of course it does indeed cause a problem for the mobile phone firms themselves, who are losing huge revenue by not selling the extra air time. The phones are sold in retail stores sometimes at a loss for the phone firm, as they obviously count on making up for it in the new additional minutes they would be selling for the same phone. This is how the prepaid cell phone company makes its profit. Trac Fone Wireless, along with other producers of these mobile phones are suing the cell phone traffickers in federal courts all around the United States…….Trac Fone and other firms like Virgin Mobile and AT&T, contend that Federal Law protects their copyrighted software and trademarks. However, there is a company called Incomtel that feels it is perfectly legal to unlock these phones so they work on any cellular system. They have filed suit against Tac Fone, arguing that Trac Fone buys their phones from Nokia and Motorola. Finland based giant Nokia as well as Motorola use their own software. They claim that Trac Fone has no right to lock the software so others cannot use them and anyone should be able to buy these particular mobile phones for use on any network.

Airlines adding iPhone capability?

In an era of history when so many of the big airlines have been severelt limiting or even monetizing their former freebies like soda pop and snacks and making you pay extortion rates for simply checking in bags, it is somewhat comforting to know that at least they are adding a few new cool features here and there:

It was recently annouced that mega airline carrier United Airlines is setting up some of their jets to accommodate passengers who want to use their iPods and iPhones.
In other iPod related news, the iPod dock now includes digital optical audio. More related Tech related News will be covered in upcoming articles.
According to a report on that cool online technology resource that we know as Tech World, The 170iTransport has been created to allow the iPod to act as a component in a top notch audio/video home entertainment system. It has digital audio output connector and component video output, plus analog audio and S-Video outputs. As you probable already know the dock allows permits you to charge the iPod.

They plan to outfit their international flights with new entertainment systems that are equipped with a 30-pin connector that will attach to the dock connector on the iPod or iPhone.

The system was developed by Panasonic Avionics and was scheduled for its first use on a flight from Washington D.C. to

Zurich on June 16th, there has been no report on how iPod users found this new way of using their iPods on the flight to date.

United Airlines plans to have all of their international flights fitted with the new systems within the next two years. This service is planned to be installed in first class and in business class for passengers by the airlines.

The personal TV has approximately a 16-inch screen and with the docking connection it will allow passengers to watch their own programs and movies on a larger screen.

Is Shared Hosting a Smart Solution?

I hope that you like this new article about whether or not shared hosting is the best solution for your hosting issues…

Whether you are just getting started with your online presence or you a
veteran with many years online, shared hosting is probably one of the
cheapest and most effective ways of hosting your own site. The vast
majority of sites are all hosted on shared servers and there is a reason
that these plans are so popular. First and foremost, they are cheap, and
second, they usually have a decent set of features that make them
worthwhile to most site owners. However, is shared, cheapest
hosting
the smartest solution for your site? Let’s take a look at some
of the pros and cons of shared web hosting.

Pros

Low cost – Most shared web hosting plans cost less than $15 per month.
If you are just running a personal site or a blog, you really don’t
want to spend much money since you won’t be generating any income on your
site.

Feature Sets – Today, the majority of shared hosting companies offer
enough features that these plans are well worth the money. From
Fantastico to unlimited email and databases,  php web hosting support etc, you can usually find a shared hosting plan that offers
everything you need.

Decent Limits – For those with basic traffic needs, the bandwidth and
disk space on a shared hosting plan are more than sufficient.

Cons

Server Issues – This is mainly a problem when you are working with a
web hosting company that has too many people on one server. Each and
every site is sharing the resources on a server and sooner or later,
something has to give. Whether one site has a traffic spike or a DDOS attack
hits, everyone else on that server is going to suffer for it.

Security Problems – Although most shared servers are quite secure,
there are a few that have had some major issues. This is usually due to
sites that are using banned applications or if one site on the server is
hit with a malicious attack. As mentioned above, DDOS attacks are also
quite common and will affect the whole server, not just the targeted
site.

Not Enough Room to Grow – If you have an ecommerce site or your site
becomes very popular, a shared web hosting plan will usually not be
powerful enough to meet your needs. You’re going to need higher levels of
disk space and transfer as well as more processing power.

Conclusion

In the end, the answer of whether shared hosting is right for you can
only come from individual site owners. Every site is different and will
have different needs. For most, shared hosting is more than sufficient,
but for those with larger sites, a bigger solution such as a VPS or
Reseller hosting package is usually better suited.

Forecast of the Information Age

I recently read a fascinating book entitled ‘The Sovereign Individual’.
I had wanted to read it since ‘Rich Dad’ author Robert Kiysaki had listed it as an influential or important book in one of his own books. One of the authors was Lord Reese-Mogg, who specializes in global strategic investments and predictions
that can affect how to invest now with various trends in mind. One of his main points in the book is that there tends to be a major shift every 500 years or so in Western civilization.
For example, the year 1492 marks the official beginning of the industrial age, thus ending the feudal age, according to many historians. Some 500 years later, in 1992, the world wide web went wide, marking the beginning of the information age and the end of the industrial age.
According to Mogg, this shift will be more pronounced even than the shift to the agrarian or industrial age. This is because microprocessing will have a more fundamnetal impact on human society as a whole, over time. He says that by the year 2050 or so the world will look much different than
it does today, as many industrial age institutions either fade away or are severely modified. The impact of all this is debatable, but Mogg says big changes are inevitable. Just as the changes made from the invention of the printing press during the industrial age could not really be stopped once the genie was out of the bottle,
so too will the changes from microprocessing and a wireless world be. It is already happening, of course. Mogg and his co-author made the fascinating point that, during the beginning stages of these types of great shifts, those on the cusp (as we are now and the Europeans of 1492 were) rarely know what is happening,or just how dramatic the shift is going be.
At the time the first printing press was invented, for instance, the church had a virtual monopoly on printing and binding books, including the Bible. It was a labor intensive craft at that time would took a high level of skill. Few people really understood at the time the full ramifications of this invention in not only ushering in the end of the dominance by the church but also the positive impact
of having books available for the first time to the masses. Literacy shot up and very soon industrial manuals and standards could be codified and made uniform in many different localities.  A factory that made an industrial product in England, for example, could quickly be duplicated in France, Holland or Germany in a uniform way. Instruction manuals could be easily made universal for the first time.
The pace of growth quickly skyrocketed. By the the late eighteenth century the standard of living of most of the advanced industrial nations shot up exponentially. For the first time unskilled labor could move to the cities and earn a wage above the normal subsistance level so common in the agrarian-fuedal area. The Feudal era was dominated by guilds, in which a relatively small number of highly skilled individuals dominated crafts such as shoe-making and
commanded large earnings while the majority of people, peasant farmers as they were, earned a rather minimal living. Suddenly unskilled workers could go to work in a factory and actually earn a surplus. Large quantities of goods became available. General prosperity and an increased standard of living soon followed.
Now we are on the cusp of a similar era, except that microprocessing and th American invented world wide web has replaced the German invented printing press. The long term and even short term effects of this shift will be truly epic, especially as the cost of wireless networks continues to tumble around the world. One thing you can do is to embrace the information age by starting an information age business. Might I recommend Freelife International  They are global, they have Himalayan goji juice and you get a free web site when you join with them.

Is Apple and other Tech companies making Changes?

In reports there may be changes on the way for iPod owners and those who plan to purchase iPods. Apple is in discussions about making the favorite download site iTunes partially free for iPod users. Rather than paying at iTunes, iPod users will be paying more for the model of iPod they choose to purchase.

While this has not been decided for sure, Apple, EMI, Sony BMG and Warner Music would not make comments about this as late as Wednesday.

In statements from David Pakman the CEO of eMusic who is a rival of the online music site iTunes commented that his concern lies with the fact that Apple may take advantage of the monopoly it has in the digital player market.

IPods represent about 85% of the digital music market online today.  If this current plan that has been leaked in some competitors thoughts, if bundled with music from iTune downloads that would be considered anti-competitive according to David Pakman.

In other Apple/iPod news the world’s most expensive iPod that has been donated to a charity auction that was held in London, United Kingdom. It is being labeled the iDiamond iPod and it was designed by a Norwegian jeweler named Thomas Heterdahl, the iPod and earplugs have been designed of solid white and pink 18 karat gold, along with the coating of 430 diamonds that includes 118 diamonds on the earplugs. Hererdahl stated that he would not design another of this one of a kind iDiamond iPod and feels that it would be quite a different situation if it were to be produced commerically

How Much Money Can I Get For My Personal Injury Case?

How Much Money Can I Get For My Personal Injury Case?
By Michael Ehline

In order to determine how much money can I get for My Los Angeles personal injury case, there are many factors to look at. One major factor is whether or not the person who caused your serious injuries in Los Angeles even had insurance.

This is true whether it is a premises liability case, car accident, or airplane crash mishap. You must first consult the below checklist to secure your rights and build the value of your Los Angeles personal injury attorney’s ability to recover money damages.

1. What Should I Do If I Am Hurt in a Car Accident?
You must take pictures with your cell phone camera, make a diary about your injuries. The law requires you make a report of the accident to the DMV. Never give a recorded statement to anyone, never admit responsibility. Only talk to your attorneys and only if you are in a confidential relationship with no conflict of interest (i.e., if you were a car passenger, make sure the car driver is represented by another lawyer, as he is potentially conflicted with your interests.)

2. How Long Will it Take to Get Money in My Case?
Before your Los Angeles Personal Injury Attorneys can get you money, or send the insurance company a settlement demand, make sure you have completed all necessary medical treatments. Normally, your attorney will get the property damage portion of your claim settled within a few months after your accident.

3. Does Failing to See a Doctor Immediately Hurt Your Insurance Claim?
Even if you’re not feeling pain right away, you must take an ambulance to the hospital. The human body produces adrenaline, a natural pain killer, when it is under the trauma of a serious auto accident, or other injury caused by negligence or willful neglect. Make sure to document when the pain started in your diary, and all your doctor visits. Failure to do the above gives the defendant an argument you are committing insurance fraud!!

4. Do I need Experienced Los Angeles Personal Injury Attorneys, or Should I Hire that Guy on the Back of the Bus or 12:00 Midnight TV?
It is always in your best interest to consult an experienced attorney. But remember, the defendant’s insurance company has a very experienced adjuster, law school graduate who never took the Bar, or full blown lawyer negotiating for them. Many TV attorneys and face men on the back of buses actually don’t even practice law. Instead, they simply have a phone bank sign you up and then get a referral fee for sending you to an inexperienced attorney. Alternatively, they have so many cases, you don’t get the personal attention you deserve. It is better to retain a boutique law firm who learned law in a law office on the California State Bar Law Office Study Program

5. The Guy Who Hit Me Didn’t have Auto Insurance; How Do I Get Paid Now?
If the Defendant was uninsured (”UM”) or underinsured (”UIM”) in a California car accident, you will need to seek recover from their personal assets. However, if you were smart, you already purchased UM, or UIM motorist coverage on your own insurance policy. Your attorneys can seek recovery against that insurance policy in that case.

6. Who Will Pay for My Medical Bills While I Wait to Get a Verdict or Settlement?
Sometimes your own insurance will pay right away. But usually they will seek reimbursement from your award. Experienced Los Angeles personal injury attorneys will review your medical coverage and discuss that option when appropriate.

7. How Do I get Around When My Car is Being Repaired?
Look at the declaration of coverages and exclusions in your insurance policy. Your policy may contain a rental car clause. Sometimes you’ll end up with a crappy car unless you pay extra. Make sure to track the expenses that went over. You may be able to get loss of use coverages for a similar car as you lost in the auto accident case.

8. I Can’t Return To Work; Are Unemployment Benefits Also Available?
Normally no, unless it was a work related injury. But often you may be able to seek state disability benefits in California.

9. Who Pays me for Dangers in the Roadway Like Potholes?
Sometimes defects in the roadway cases damages to your car due to improper maintenance or repair. Often you will need to file a government claim. There is a statute that requires you to file a claim within six months of the damages. Good luck!!

10. How Much Money Will I Get if I do the Above Things?
There are many considerations to determine the amount of an award or settlement. You are usually entitled to seek lost of wages, pain and suffering, property loss, like your car. Assuming it’s not a Prop 213 case, all damages will be considered. Your attorneys review the case and do a work up in order to give you an estimated amount of reasonable jury verdict or settlement in your accident claims.

11. Is It Better to Settle Instead of a Jury Trial?
Not usually. A jury trial in California courts can take months and sometimes you’ll get less than the insurance company was willing to settle the case for. Plus the attorney’s contingency fee will normally go up and you could even end up paying the defendant’s costs and attorney’s fees even if you win!! (See Code Civ. Pro. Sec. 998.) You must weigh the risks and benefits.

12. What if The Defendant’s insurance company offered me money. Should I Accept the Settlement and Cut Out a Lawyer?
Only if you want to get ripped off. Insurance companies know you have no idea what your case is worth. They will offer you a fraction of what an experienced personal injury attorney in Los Angeles would get you. Contact and retain an attorney and watch insurance company’s offer increase. Never take money from an insurance company unless you consult with a lawyer first.

13. But What If I Can’t Afford an Experienced Attorney?
Los Angeles personal injury attorneys usually work on a contingency fee basis. Normally, in cases like that, you pay nothing unless there is a recovery. If your lawyer wins your case, you get a percentage less the contingency fee. You and your attorneys agree on this in advance with consent after consultation. How much money can I get for my Los Angeles personal injury case depends upon the above factors, so it is imperative that you get a lawyer before the statute of limitation expires in your civil cases.

Personal Injury Lawyers in Los Angeles represent injured victims in California and are recognized as by their clients as the best Los Angeles car accident attorneys
